摘　　要： 慎刑慎杀的刑事诉讼基本理念是我国传统法律文化的重要组成部分,经过长期发展,延续至今。论题概括了慎刑慎杀的刑事诉讼基本理念的历史发展过程,分析了其确立依据,阐述了其主要表现和司法价值,指出了其对当前刑事司法的启示意义。 The basic idea of the discreet penalty and the discreet death penalty in criminal procedure is an important part of Our traditional legal culture, and it has a long history. After a long-term development it is not a concept of the past. This thesis explains the developing process of the basic idea of discreet penalty and the discreet death penalty in criminal procedure then analyzes its establishing basis and summarizes its primary manifestation and judicial value, and meanwhile, discloses the revelation for the present criminal justice.
