摘　　要： 司法现代化是法治文明和法治成熟的主要标志。由于城乡司法环境的明显差异,在探索我国司法现代化的路径时,不应当走城乡一体化的道路,而应根据司法现代化的基本标准,并立足"三农"实际,通过改革农村司法管理体制、设立适应新农村建设需要的司法或准司法机构、合理开发与配置农村司法人力资源以及实现农村司法保障国家化等进路,逐步实现农村司法现代化,为新农村建设提供有力的法治保障。 Judicial modernization is the main indicator of legislative civilization and legislation. Due to significant differences between urban and rural judicial environments, the integrated approach is not suitable for exploring the approaches to China^s judicial modernization. In accordance with the basic criteria of judicial modernization and actual situations of farmers, agriculture and rural areas, the judicial modernization in rural areas should be implemented gradually by reforming the judicial administration system in rurat areas, setting up judicial or quasi-judicial authorities that are suitable for construction guarantee^f new countryside,in rural areas by the state so as to provide judicial guarantee for rural areas.
