摘　　要： 在全面依法治国以及深化党和国家机构改革的背景下,现有的司法行政职能应当转变为法治事务管理职能。而法治事务管理是指国家行政机关对支持、服务和保障法治运行的相关事务所进行的管理活动,具有法律性、宽泛性、统一性等显著特点。当前的法治事务管理存在职能机构的名称不能反映新时代法治事务管理的需要、管理的范围不能适应全面依法治国的要求、管理依据的法律法规和规章不够健全、各项法治事务管理之间的衔接与协调机制不够完善等问题。为此,应当加强顶层设计,推进体制改革和制度创新,建立健全法治事务管理,包括将司法行政机关调整为法治事务管理机关,将信访工作纳入法治事务管理范围,赋予法治事务管理机关统一管理法治人才培训工作以及法治建设评价和法治建设协调等职能。 In the context of the rule of law in an all-round way and deepening reform of the Party and national institutions,the existing judicial and administrative functions should be transformed to management functions over affairs concerning the rule of law. This management refers to the activities that the national administrative departments manage the relevant matters of supporting,serving and guaranteeing the operation of the rule of law,which embodies the legality,broadness,uniformity and other notable features. Problems exist in current management of affairs concerning the rule of law,which include the disagreement between the names of functional institutions and the needs of management of affairs concerning the rule of law in the new era,the maladjustment of the scope of management to the requirements of the rule of law in an all-round way,the imperfection of laws and regulations on which the management is based and the incompleteness of the cohesion and coordination mechanism between the management of different matters relating to the rule of law. Accordingly,it is suggested to improve the top-level design,and promote structural reform and institutional innovation. Meantime,the management of affairs concerning the rule of law should be established and improved,which involves transforming judicial and administrative organs to management authorities of affairs concerning the rule of law,including work relating to the handling of petitioning letters and visits into the scope of management of affairs concerning the rule of law,and granting to management authorities of affairs concerning the rule of law the functions of unified management of the training of talents for the rule of law,as well as evaluation and coordination of the construction of the rule of law.
