摘　　要： 宅基地是中国农村土地制度安排中最特殊、利益影响最敏感的一块地,也是一直以来各方争议最大、改革最滞后的一块地。现有宅基地使用权具有无偿分配、长期持有、交易受限等典型的福利制度特征,在实践中面临用地无序扩张与闲置浪费并存、非法入市交易大量存在等问题,这构成了宅基地制度改革的现实逻辑基础。本文应"三权分置"的宅基地改革需要,围绕产权、市场和管制三个基本制度要素,提出"拓展权能、交易赋权与适度管制"的宅基地制度改革线索。依循改革线索,提出立法改革的具体举措及配套政策。 Rural homestead is the most special and sensitive land in China’s rural land system.It is also the most controversial and also the most lagging field of reform.The existing homestead use right has the typical characteristics of the welfare system,such as free distribution,long-term holding,restricted transaction,etc.In practice,it faces the problems such as the coexistence of disordered expansion of land and idle waste of land,and the growing rapidly development of illegal market transaction,which constitute the realistic and logical basis for the reform of homestead system.In order to meet the needs of the homestead system reform of 'three-right separation',based on the three basic system elements of property right,market and regulation,this paper puts forward the homestead system reform clue of 'expansion of property rights,empowerment of transactions and moderate regulation',and the specific reform measures and supporting policies.
